DMCA Policy

Bread Machine Cucumber Chocolate Chip ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Bread Machine Cucumber Chocolate Chip service and/or website (the "Site") if such claims are reported to our Designated Copyright Agent identified below.

This policy describes the information that should be present in a DMCA Notice and Counter-Notice. It is designed to make the process of reporting and resolving claims of copyright infringement as straightforward as possible.

Filing a DMCA Notice of Infringement

If you are a copyright owner, or are authorized to act on behalf of one, and you believe your work has been copied in a way that constitutes copyright infringement, please submit a written notification ("DMCA Notice") to our Designated Copyright Agent with the following information:

  1. Identification of the copyrighted work claimed to have been infringed: This must include a description of the copyrighted work, and where possible, a copy or the location (e.g., URL) of an authorized version of the work.
  2. Identification of the material that is claimed to be infringing: This must include a description of the infringing material and its location on the Bread Machine Cucumber Chocolate Chip Site (e.g., URL(s) where the material can be found).
  3. Sufficient information to permit us to contact the complaining party: This should include your name, mailing address, telephone number, and, if available, an email address.
  4. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Filing a DMCA Counter-Notification

If you believe that your content was removed or access disabled by mistake or misidentification, you have the right to file a counter-notification with us. Your counter-notification ("DMCA Counter-Notification") must be a written communication provided to our Designated Copyright Agent and must include substantially the following:

  • Identification of the material that has been removed or to which access has been disabled: This must include the URL(s) at which the material appeared before it was removed or access disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside of the U.S., for any judicial district in which Bread Machine Cucumber Chocolate Chip may be found), and that you will accept service of process from the person who provided the original DMCA Notice or an agent of such person.
  • Your physical or electronic signature.

Please send your DMCA Counter-Notification to our Designated Copyright Agent via our Contact Us page, clearly marking the subject "DMCA Counter-Notification."

Upon receipt of a valid DMCA Counter-Notification, we will promptly forward a copy to the complaining party who submitted the original DMCA Notice. If the complaining party does not inform us that they have filed an action seeking a court order to restrain you from engaging in infringing activity related to the material on the Bread Machine Cucumber Chocolate Chip Site within ten (10) business days, we may restore the removed material or cease disabling access to it.
